MyAura Terms of Service

1. Agreement to Terms

By creating an account, subscribing to MyAura, or using any portion of the platform, you agree to be bound by these Terms of Service.

If you do not agree to these Terms, you may not access or use MyAura.

2. Description of Service

MyAura is a software platform that provides customer relationship management (CRM), marketing automation, website and funnel building, appointment scheduling, communications, artificial intelligence tools, and related business services.

MyAura provides software tools only and does not provide legal, financial, accounting, tax, or business advice.

3. Eligibility

To use MyAura, you must:

• Be at least 18 years old.

• Have the legal authority to enter into a binding agreement.

• Provide accurate and complete account information.

• Use the platform in compliance with all applicable laws and regulations.

4. Account Ownership and Responsibility

The subscriber is the owner of their account and is responsible for all activity occurring under that account.

You are responsible for:

• Maintaining accurate account information

• Protecting login credentials

• Restricting unauthorized access

• All activity conducted through your account

MyAura may access your account when necessary to provide support, maintenance, troubleshooting, or account management services.

5. Content Creation

Subscription fees are billed in advance on a recurring monthly basis.

By subscribing, you authorize MyAura to automatically charge your payment method for all applicable subscription fees.

Subscription fees are non-refundable once a billing period has begun.

MyAura reserves the right to modify pricing with reasonable advance notice.

6.Usage-Based Charges

Certain services may incur additional charges beyond your monthly subscription fee.

These services may include, but are not limited to:

• Email sending

• SMS messaging
• WhatsApp messaging
• Voice calls
• AI usage
• Domain registrations
• Third-party integrations
• Advertising spend
• Other third-party platform fees

You are responsible for all usage-based charges incurred through your account.

7. Marketing and Communications Compliance:

You are solely responsible for all communications sent through MyAura.

You agree to comply with all applicable laws and regulations relating to:

• Email marketing

• SMS messaging

• WhatsApp messaging

• Telemarketing

• Data privacy

• Consumer protection

• Advertising

You are responsible for obtaining all necessary permissions and consent from your contacts prior to sending communications through the platform
MyAura is a software provider only and is not responsible for the content, timing, recipients, or legality of communications sent through your account.

8. Third-Party Services

MyAura integrates with third-party services including, but not limited to:

• GoHighLevel

• OpenAI

• Meta

• Google

• Twilio

• WhatsApp

• Stripe

• Zoom

• Other software providers

MyAura is not responsible for outages, interruptions, pricing changes, policy changes, data loss, or service disruptions caused by third-party providers.

Your use of third-party services may be subject to additional terms and conditions imposed by those providers.

9. Artificial Intelligence Features

MyAura may provide access to artificial intelligence tools and features.

AI-generated content, recommendations, responses, and automations may contain inaccuracies or errors.

You are solely responsible for reviewing, approving, and verifying all AI-generated outputs before publishing, sending, or relying upon them.

MyAura makes no representations regarding the accuracy or suitability of AI-generated content

10. User Content and Data

You retain ownership of all content, contacts, images, videos, documents, communications, and customer data uploaded to your account.

By using MyAura, you grant MyAura permission to process, store, transmit, and display such data solely for the purpose of providing platform services.

You represent and warrant that you have all necessary rights and permissions to upload and use any content within the platform.

11. Prohibited Activities

You may not use MyAura to:

• Send spam or unsolicited communications

• Promote illegal products or services

• Engage in fraudulent activity

• Distribute malware or harmful software

• Harass, threaten, or abuse others

• Violate intellectual property rights

• Violate applicable laws or regulations

MyAura reserves the right to suspend or terminate accounts engaging in prohibited activity.

12. Platform Availability

MyAura strives to maintain reliable service but does not guarantee uninterrupted availability.

The platform may experience downtime due to:

• Maintenance

• Updates

• Third-party outages

• Internet disruptions

• Events beyond our reasonable control

MyAura shall not be liable for losses arising from interruptions in service.

13. No Guarantees

MyAura provides software tools designed to support business operations and marketing activities.
MyAura does not guarantee:

• Leads

• Bookings

• Sales

• Revenue

• Email deliverability

• Advertising performance

• Marketing results

• Business growth

Results depend on many factors beyond MyAura's control.

14. Intellectual Property

The MyAura platform, software, branding, design elements, and proprietary systems remain the property of MyAura.

Nothing in these Terms transfers ownership of MyAura intellectual property to the subscriber.

Subscribers retain ownership of their own content and customer data.

15. Limitation of Liability

To the fullest extent permitted by law, MyAura shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use of the platform.

MyAura's total liability for any claim shall not exceed the total subscription fees paid by the subscriber during the three (3) months immediately preceding the event giving rise to the claim.

16. Disclaimers

You agree to indemnify, defend, and hold harmless MyAura, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, and expenses arising from:

• Your use of the platform

• Your communications with customers

• Your marketing activities

• Your violation of these Terms

• Your violation of applicable laws or regulations

17. Cancellation and Termination

You may cancel your subscription at any time.

Your account will remain active through the end of the current billing period.

No partial-month refunds will be issued.

MyAura reserves the right to suspend or terminate accounts for:

• Non-payment

• Fraudulent activity

• Abuse of the platform

• Violations of these Terms

• Activity that creates risk to the platform or its users

18. Modifications

MyAura reserves the right to modify these Terms of Service at any time.

Continued use of the platform following any update constitutes acceptance of the revised Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States of America, without regard to conflict of law principles.

By subscribing to MyAura, creating an account, or using the platform, you acknowledge that you have read, understood, and agree to these Terms of Service.
